High Court decision puts the onus squarely on Malcolm Turnbull (SMH, 4 February 2016): "The most prudent course would be to say little and do nothing that will compound the distress of those who, after all, were only brought back to Australia because of serious mental and physical health concerns... If it really believes it can't say that vulnerable families and children will be allowed to stay in Australia, it can assess each case individually and not act in a way that will cause even more harm than has been done already."

Once removed, their fate is put beyond Australian law and the oversight of our courts... This is true even if that state, as is the case with Nauru, is beholden to Australia, and has a dubious record of upholding the rule of law within its own borders. In such a case, asylum seekers can find themselves removed from Australia to what is in effect a legal black hole." (I can't help thinking of the CIA's "black sites".)
